RENTAL AGREEMENT
WHEREAS with this present agreement, the company named ‘PIER 1’ (hereinafter called "Lessor", a sub-franchise under license to use the trademark of "PIER 1 CAR RENTAL" for its own benefit and purposes) hereby rents to the "Renter" the vehicle, as described herein (including any replacement vehicle), subject to the following terms and conditions, as well as those included on the front side hereof, which the Renter fully accepts in their entirety.
1. DRIVER'S AGE
Minimum age is 21 years for credit card holders and 23 years for non-credit cardholders for car Groups A, B, B1, C, D, E, F, H. For all other car Groups J, G, K, W, minimum driver’s age is 25 years.
2. DRIVER'S LICENSE
A valid driving license held for at least one year is required.
3. DEPOSITS – MINIMUM RENTAL
Deposits for estimated charges are required at the beginning of the rental, unless a credit card is provided. The minimum rental period is one day (24 hours). Every additional hour is charged at 1/5 of the daily rate. Rentals exceeding three additional hours will be charged a full extra day.
4. DELIVERY AND RECEIPT
The Renter receives the vehicle in perfect condition, appropriate for its intended use. The vehicle, along with all accompanying documents and equipment, must be returned to the Lessor in the same condition, at the location and date specified in the agreement. Failure to comply will result in the Renter being charged the normal rental fee and additional expenses for loss or damage. The Lessor retains the right to repossess the vehicle at any time, at the Renter’s expense, without notice, especially if there is risk of damage, loss, or non-payment.
5. THEFT (TPC), DAMAGE (CDW)
The Renter is responsible for all damages or losses, unless specific waivers are accepted. If the Theft Protection Clause (TPC) is accepted at the beginning of the rental, and all precautions were taken, the Renter may be released from responsibility in case of full theft. Partial theft is not covered. For collision or fire damage, the Collision Damage Waiver (CDW) may cover expenses, provided the Renter used the vehicle according to the agreement. Even with CDW, a minimum charge may apply unless Full Damage Waiver (FDW) is accepted. CDW or FDW does not cover damage underneath the vehicle, to tires and wheels, or damage during loading/unloading or transport by train/ship without Lessor’s written consent.
6. CHARGES
The Renter shall pay: the daily rental charge, any charges per kilometer unless agreed otherwise, fuel costs if not returned at the same level, and all applicable insurance and waiver charges. Taxes, duties, legal fees, fines, penalties, and costs for tire/wheel damage or damage to the lower part of the vehicle are also chargeable unless covered by waiver. Extra charges apply for vehicle delivery/return outside the agreed location and for airport rentals. All charges are subject to final audit, and any granted discounts are revoked if payments are delayed.
7. TERMS OF USE
The Renter must care for the vehicle, maintain its mechanical condition, and use it prudently. The vehicle must not be used outside Greece, for towing, racing, subleasing, illegal activities, or by unauthorized drivers. Transport of dangerous or illegal materials is prohibited. The vehicle must not be driven under the influence of alcohol, drugs, or impairing substances.
8. EXTENSION OF RENTAL PERIOD
To extend the rental, the Renter must notify the Lessor in writing at least 24 hours before the end of the rental period. Unauthorized extensions may result in civil and penal liabilities. In case of extension, all original terms apply.
9. INDEMNITY
The Lessor is not liable for any loss or damage to the Renter or third parties during the rental period.
10. ACCIDENTS
In case of accident or incident, the Renter must not admit fault, must collect information from involved parties and witnesses, notify the police, contact the Lessor, take photographs, and submit a signed accident report within 24 hours. Theft or loss must be reported to the police within 12 hours in writing.
11. INSURANCES
The Lessor provides insurance for third-party death or injury up to €500,000 and material damage up to €100,000 (excluding the vehicle driver). Personal Accident Insurance (PAD) is optional and must be accepted separately. Luggage and personal property are not insured.
12. PERSONAL DATA
The Renter consents to the storage and use of personal data. If the Renter provides false information or breaches the agreement, data may be disclosed to authorities.
13. MISCELLANEOUS
The vehicle remains property of “PIER 1.”
This is a rental agreement only; the Renter is not an agent of the Lessor.
Additional drivers are jointly responsible. Any prior agreements are overridden. No right of the Lessor may be waived unless in writing. The terms apply to both the original and any extension or replacement. In case of discrepancy, the Lessor’s original document prevails. In case this agreement is signed by any representative of the Renter, he will also be jointly and severally liable with the Renter. This agreement supersedes any other prior written or verbal agreement between the Lessor and the Renter. The Lessor cannot waive any of its rights deriving from the law and this agreement. Any alteration of the terms of this agreement is not valid unless agreed in writing. Renter agrees and accepts that all the above-mentioned terms are valid both in case of the initial agreement with the Lessor and in any case of extension of the rental time and/or replacement of the Vehicle by another. In case there is any difference between the copies and the original of this agreement, the original possessed by the Lessor always supersedes. The contracting parties acknowledge and accept that the terms of this agreement are substantial and fundamental for the purposes herein.
14. JURISDICTION
This agreement is governed by Greek legislation, and any and all disputes which may arise between Lessor and Renter shall be subject to the exclusive jurisdiction of the courts where the Lessor’s company is registered.
15. IMPORTANT NOTICE
It is the Renter’s responsibility to contact the rental branch before accepting the vehicle if there is any dispute regarding its condition. Damages to the underside of the vehicle or to wheels and tires are not covered by any insurance. In case of early cancellation by the Renter without the company’s fault, the rental fee is non-refundable. The number of passengers must not exceed five persons or the number of available safety belts. In the event of exceeding the limit, the rental will be terminated, and a fine of €400 will be imposed.
